WHARTON, Texas — Wharton City Councilmember Burnell Neal was found guilty of assault causing bodily injury involving family violence by a Wharton County jury on November 2, 2026. Prosecutors say the case stemmed from an incident in which Neal struck his wife in the face.
Neal, who represents District 1 on the Wharton City Council, was ordered to serve 51 days in county jail as a condition of 12 months of probation. The Wharton County District Attorney’s Office announced additional details about the case in a press release.
Prosecutors Describe Incident Involving Neal’s Wife
According to the District Attorney’s Office, Wharton police responded to a residence on March 22, 2025, after receiving a 911 call reporting a disturbance. Officers learned at the scene that Neal had assaulted his wife by striking her in the face, the release states.
The District Attorney’s Office said a jury found Neal, 62, guilty of the Class A misdemeanor after he pleaded not guilty. The jury also made an affirmative finding of family violence. Neal chose to have the judge determine his punishment.
51 Days in Jail and 12 Months of Probation
Judge Phillip Spenrath imposed a 365-day county jail sentence, suspended while Neal serves 12 months of community supervision, commonly called probation.
Under the judgment obtained by Wharton Post, Neal must serve 51 days in the Wharton County Jail, with credit for one day previously served. The order lists November 2 as the start date of confinement.
Neal was also ordered to pay a $1,000 fine, perform 30 hours of community service and complete a Batterers Intervention Program. Other supervision conditions include reporting to a probation officer and complying with alcohol and drug restrictions.
Two Additional Felony Charges Pending
The District Attorney’s Office also reported that Neal faces two separate third-degree felony charges arising from the same incident: injury to a child and injury to an elderly person.
According to prosecutors, both charges remain pending in the 329th Judicial District Court of Wharton County. They have not been resolved by the misdemeanor jury verdict reported here, and Neal is presumed innocent of those pending charges unless proven guilty.
City Responds to Questions About Council Seat
Wharton Post previously contacted the City of Wharton regarding Neal’s jail booking and his continued service as an elected official.
City Secretary and Assistant City Manager Paula Favors said Neal had not been in contact with the City at the time of her response and referred questions about the misdemeanor proceedings to the County Clerk’s Office.
Favors also stated that the matter did not preclude Neal from serving on the City Council under Texas law. Her response preceded Wharton Post’s receipt of the judgment confirming the conviction. That legal assessment is attributed to the City.
District Attorney Discloses Prior Representation
In its release, the District Attorney’s Office said District Attorney Mark Racer previously represented Neal in an unrelated legal matter before taking office. The office stated that Racer did not participate in the investigation or prosecution of this case.
The release identifies First Assistant District Attorney Christine E. Patty and Assistant District Attorney Joshua A. Weber as the prosecutors.
The District Attorney’s Office commended the jury and Wharton Police Department for their roles in the case.
Court Records and Sources
Wharton Post obtained the judgment and sentencing documents from the Wharton County Clerk’s Office in State of Texas v. Burnell Neal, Cause No. 73645. The original judgment mistakenly listed February 9, 2013, as the offense date. On November 4, 2026, Judge Phillip Spenrath signed an order granting a motion for judgment nunc pro tunc, correcting the offense date to March 22, 2025. The correction aligns the judgment with the incident described by prosecutors and does not change the guilty verdict or sentence.
